A BILL FOR AN ACT

 

 

relating to health insurance.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 431:14G, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§431:14G-     Public review and comment.  (a)  Upon receipt of a rate filing requesting a rate change, the commissioner, within three business days, shall post the rate filing and a plain-language explanation of the rate filing on the commissioner's website.

     (b)  The rate filing shall be available for public review and comment through the commissioner for a period of thirty days.  An accident and health or sickness insurer under article 10A, a mutual benefit society under chapter 432, or a health maintenance organization under chapter 432D that has submitted a rate filing shall respond to comments received during the review and comment period.  During the public review and comment period, the commissioner shall hold a public hearing on the rate filing at which the insureds, members, and enrollees of the accident and health or sickness insurer, mutual benefit society, or health maintenance organization, respectively, may testify.

     (c)  The public review and comment period may run concurrently with the waiting period described in section 431:14G-105(g)."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
