A BILL FOR AN ACT
relating to meetings of boards of directors.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 421J-5, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:
"(a) All meetings of the board of directors, other than executive sessions, shall be open to all members to provide input on the matters being discussed. Members who are not on the board of directors may participate in any deliberation or discussion, other than during executive sessions, unless a majority of a quorum of the board of directors votes otherwise. Notice of the board meeting, which shall include an agenda for the meeting, shall be posted in prominent locations within the planned community seventy-two hours prior to the meeting or simultaneously with notice to board members. Notice shall be provided to each member of the association who requests that notice, and may be provided by mail, personal delivery, electronically, or through an association website. The association may set and charge fees to cover the costs of the notice to members."
SECTION 2. Section 514B-125, Hawaii Revised Statutes, is amended by amending subsection (d) to read as follows:
"(d) The board shall meet at least once a year. Notice of all board meetings, which shall include an agenda for the meeting, shall be posted by the managing agent, resident manager, or a member of the board, in prominent locations within the project seventy-two hours prior to the meeting or simultaneously with notice to the board. Notice shall be provided to each member of the association who requests such notice, and may be provided by mail, personal delivery, electronically, or through an association website. The association may set and charge fees to cover the costs of the notice to members."
SECTION 3. New statutory material is underscored. SECTION 4. This Act shall take effect upon its approval.
