A BILL FOR AN ACT

 

 

RELATING TO HIGHWAYS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 264, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§264-    Highway lighting; shielded lighting fixtures required.  (a)  Effective January 1, 2012, no lighting fixture shall be installed on any public highway unless the lighting fixture is a full-cutoff or semi-cutoff lighting fixture.

     (b)  This section shall not apply to any lighting fixture that is:

     (1)  Planned and approved by the appropriate government authority; or

     (2)  Existing and legally installed,

prior to January 1, 2012; provided that any lighting fixture exempt under this subsection that subsequently becomes inoperable shall be replaced with a full-cutoff or semi-cutoff lighting fixture that provides illumination and uniformity that is equal to or better than the recommendation of the Illuminating Engineering Society of North America; provided further that if the appropriate fixture for the existing light pole spacing is not available, a non-complying fixture that meets the illumination and uniform design criteria of the Illuminating Engineering Society of North America shall be allowed.

     (c)  For the purposes of this section:

     "Full-cutoff" means the lighting fixture is constructed so that all of the light emitted by the fixture is projected below the horizontal plane of the lowest point of the fixture.

     "Lighting fixture" means any outdoor artificial lighting device, fixture, lamp, or other similar device that is intended to provide illumination for visibility.

     "Semi-cutoff" means the lighting fixture is constructed so that at least ninety per cent of the light emitted by the fixture is projected below the horizontal plane of the lowest point of the fixture."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.

Description:

Requires, effective January 1, 2012, that all new lighting fixtures installed on public highways be full-cutoff or semi-cutoff lighting fixtures, to minimize glare and light pollution.  Provides for certain exemptions.  (HB1473 HD1)
