A BILL FOR AN ACT
RELATING TO HEALTH.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 321, Hawaii Revised Statutes, is amended by adding a new section to part VII to be appropriately designated and to read as follows:
"§321- Sale of beverages as part of a children's meal. (a) A children's meal sold or offered for sale at any food establishment shall include only bottled water or low-fat milk as a beverage option included in the price of the children's meal. No other beverage option shall be included in a children's meal without an additional charge and no discount shall be provided for any other beverage option contingent upon purchase of a children's meal.
(b) Any person who violates this section shall be subject to a fine of not less than $ per violation nor more than $ per violation.
(c) The department shall adopt rules pursuant to chapter 91 to implement this section.
(d) For purposes of this section:
"Children's meal" means any combination of food and beverage items sold for a single, comprehensive price that is primarily marketed to, intended for, or sold to children years of age or younger."
SECTION 2. If any provision of this Act, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of the Act that can be given effect without the invalid provision or application, and to this end the provisions of this Act are severable.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
