A BILL FOR AN ACT

 

 

relating to The pledge of allegiance.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to part II, subpart B, to be appropriately designated and to read as follows:

     "§302A-    Pledge of allegiance.  (a)  Each public school classroom shall begin the school day with the pledge of allegiance.

     (b)  No member of the board of education or employee of the department shall alter the words used in the oral recitation of the pledge of allegiance.

     (c)  No public school student shall be compelled, against the student's objections or the objections of the student's parent or guardian, to recite the pledge of allegiance or stand during the recitation of the pledge of allegiance in any classroom or activity of the public school.

     (d)  No public school student, teacher, or staff member shall admonish or harass a student for their non-participation in a recitation of the pledge of allegiance in any classroom or activity of the public school.

     (e)  Each student shall be informed of this section by the posting of a notice in a conspicuous location at each public school.

     (f)  The department shall adopt rules under chapter 91 to carry out the purposes of this section."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
