HOUSE OF REPRESENTATIVES

H.B. NO.

1379

TWENTY-NINTH LEGISLATURE, 2017

STATE OF HAWAII

A BILL FOR AN ACT

relating to after-school programs.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1.  The legislature finds that many schools restrict or prohibit department of education employees from distributing information on community sponsored after-school programs.  The legislature further finds that these restrictions and policies serve to isolate schools and conflict with the goal that each school be an integral part of its community.

The purpose of this Act is to allow for the reasonable promotion of community-sponsored after-school programs by department of education employees.

SECTION 2.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

"§302A-     After-school programs; promotion.  Any employee of the department may voluntarily promote a community-sponsored after-school program by making announcements, posting notices, and communicating information of the after-school program; provided that:

     (1)  The after-school program and the promotional efforts have been approved by the principal; and

     (2)  The promotion does not impose an unreasonable added workload on the employee.

     (b)  Notwithstanding any other law to the contrary, no employee of the department shall be liable for any claim arising out of the employee's promotion of a community-sponsored after-school program pursuant to this section."

SECTION 3.  New statutory material is underscored.

SECTION 4.  This Act shall take effect upon its approval.
