A BILL FOR AN ACT

 

 

RELATING TO MARINE EVENTS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 200, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

     "§200-    Regattas, marine parades, and surfing contests; permits; fees; deposits.  (a)  No person shall hold a regatta, marine parade, or surfing contest without first obtaining a permit from the department, except that a permit from the department is not required if prior authorization has been secured from the Coast Guard.

     (b)  All permit applications shall be on a form prescribed by the department.  The department may assess and collect a fee for the processing of the permit.

     (c)  Permit applications may be submitted to the department up to one year before the start of a proposed event, and shall be submitted to the department no less than forty-five days before the start of a proposed event.  The department shall notify an applicant in writing that it has received a completed application or has received an incomplete application, in which case the department shall specify why the application is incomplete.  The department shall use its best efforts to approve or deny a permit within thirty days of receipt of a completed application.

     (d)  The department shall collect a $250 deposit that is nonrefundable if an event is canceled within sixty days of the start of the event.

     (e)  The department may adopt rules, pursuant to chapter 91, necessary to effectuate this section.

     (f)  As used in this section, "regatta", "marine parade", or "surfing contest" means an organized water event of limited duration that is conducted according to a prearranged schedule and that, by its nature, circumstances, or location, will introduce extra or unusual hazards to the safety of persons or property on the waters of the State."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2050.

Description:

Requires a permit from the Department of Land and Natural Resources before holding a regatta, marine parade, or surfing contest.  Requires permit applications to be submitted up to one year and at least forty-five days before the start of the proposed event.  Allows DLNR to assess and collect a fee for permit processing.  Requires DLNR to collect a deposit that is nonrefundable if the event is canceled within sixty days of the start of the event.  Effective 7/1/2050.  (SD1)
