A BILL FOR AN ACT


 

 

RELATING TO Solid Waste Pollution.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 342H, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§342H-     Injection wells; limitations on placement.  No permit shall be issued for the construction or operation of any type of injection well in a special management area if the wastewater to be deposited in the well will not meet the standards established by the department for R-1 water.

For the purposes of this section, "injection well" means a device that places waste underground by means of a bored, drilled, or driven shaft, a hole dug deeper than it is wide, an improved sinkhole, or a subsurface fluid distribution system.

For the purposes of this section, "shoreline" shall have the same meaning as in section 200-1."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

     SECTION 3.  New statutory material is underscored.

SECTION 4.  This Act shall take effect upon its approval.
