A BILL FOR AN ACT

 

 

relating to medicaid.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 431L, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§431L-     Modification of reimbursement policies and guidelines.   (a)  No  nonprofit or for-profit medicaid health insurance contractor, or the MedQuest division of the department of human services, shall modify medicaid reimbursement policies and guidelines without providing written notice of the change as required by the Centers for Medicare and Medicaid Services.

     (b)  No modification shall be applied retroactively if approval for reimbursement was obtained from medicaid or a medicaid health insurance contractor prior to any notice given pursuant to subsection (a), regardless of the effective date of the modification contained in the notice."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
