A RESOLUTION


Declaring the General Assembly's position that neither the state nor its citizens are obligated to comply with the dictates of a presidentially appointed "czar"; and for other purposes.

WHEREAS, while the term "czar" within the meaning of presidential appointees is a press created, rather than a political, term, Mr. Bradley Patterson, who served on the White House staffs of three different Presidents and is one of the nation's leading authorities on presidential staffing, makes the case that such term should be reserved for a White House advisor who works on pressing issues requiring interagency coordination, who has not undergone Senate confirmation, and who reports directly to the President; and

WHEREAS, while such positions have been found in administrations as far back as that of Calvin Coolidge, recent administrations have tended to make more numerous such appointments; and

WHEREAS, whether and how these positions are consistent with the "Appointments Clause" in Article II, Section 2 of the United States Constitution, which states that the President "shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States" is a subject of congressional debate, including ongoing hearings by a Senate Judiciary Committee subcommittee; and

WHEREAS, the "Supremacy Clause" found in Article VI, Paragraph 2 establishes the Constitution, federal statutes, and U.S. treaties as "the supreme Law of the Land"; and it is the position of this body that any dictates of a "czar" appointed by a President without Senate confirmation are not binding on this state or the citizens of this state.

NOW, THEREFORE, BE IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA that the members of this body give notice that they do not consider themselves or the citizens of this state bound to comply with the orders of any presidentially appointed czar.

BE IT FURTHER RESOLVED that the Clerk of the House of Representatives is authorized and directed to transmit copies of this resolution to the Georgia delegation to Congress.
