The
House Committee on Appropriations offers the following substitute to HB
869:
A
BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Title 28 of the Official Code of Georgia Annotated, relating to the
General Assembly, so as to provide that the Legislative Services Committee may
direct a reduction in the amount of the salary otherwise received by members and
officers of the General Assembly; to provide for related matters; to provide an
effective date; to repeal conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Title
28 of the Official Code of Georgia Annotated, relating to the General Assembly,
is amended in Code Section 28-1-8, relating to salary and allowance of members
of the General Assembly, by revising subsection (a) as follows:
"(a)
Each
Except as
provided in Code Section 28-4-2.1, each
member of the General Assembly shall receive an annual salary, as provided for
in Code Section 45-7-4, to be paid in equal monthly installments. Upon
complying with the requirements of paragraph (22) of subsection (a) of Code
Section 45-7-4, each member shall also be reimbursed for those actual expenses
incurred in the performance of duties for which reimbursement is provided in
paragraph (22) of subsection (a) of Code Section 45-7-4. The Speaker of the
House of Representatives, the Speaker Pro Tempore of the House of
Representatives, and the President Pro Tempore of the Senate shall receive an
additional amount per annum as provided for in Code Section 45-7-4. The
majority leader, the minority leader, the administration floor leader, and the
assistant administration floor leaders of the House of Representatives and the
majority leader, the minority leader, the administration floor leader, and the
assistant administration floor leaders of the Senate shall each receive such
additional amount per annum as shall be provided by resolution of the respective
houses; but such amount for each shall not be greater than the additional amount
provided by law for the Speaker Pro Tempore of the House of Representatives.
All of such additional amounts shall also be paid in equal monthly
installments."
SECTION
2.
Said
title is further amended by adding a new Code section to read as
follows:
"28-4-2.1.
(a)
The Legislative Services Committee may direct a reduction in the amount of the
salary which would otherwise be received by members and officers of the General
Assembly under Code Section 45-7-4.
(b)
Any such reduction shall be in the form of a percentage reduction equivalent to
not more than one day's pay per month. The duration of the salary reduction
pursuant to any single authorization by the committee shall not exceed six
months; but the committee may by further authorization provide for one or more
further periods of salary reduction.
(c)
Any action under this Code section shall require the affirmative votes of
two-thirds of the entire membership of the Legislative Services Committee. The
committee meeting at which such action is taken shall be open to the public; and
at least one week's prior notice of the meeting shall be given by publication on
the General Assembly's website or other means or
both."
SECTION
3.
This
Act shall become effective upon its approval by the Governor or upon its
becoming law without such approval.

4.
All
laws and parts of laws in conflict with this Act are repealed.
