A BILL TO BE ENTITLED
AN ACT

To amend Article 1 of Chapter 13 of Title 50 of the Official Code of Georgia Annotated, relating to general provisions for administrative procedure, so as to define a term; to clarify that a party under the "Georgia Administrative Procedure Act" may act pro se or be represented by a designee under certain circumstances; to provide for related matters; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Article 1 of Chapter 13 of Title 50 of the Official Code of Georgia Annotated, relating to general provisions for administrative procedure, is amended by adding a new paragraph to Code Section 50-13-2, relating to definitions, as follows:
"(3.3) 'Natural person' means an individual human being and does not include any partnership, corporation, association, governmental subdivision, public or private organization of any character, trust, firm, or agency."

SECTION 2.
Said article is further amended by revising paragraph (3) of subsection (a) of Code Section 50-13-13, relating to the opportunity for hearings in contested cases under the "Georgia Administrative Procedure Act," as follows:
"(3) All parties Opportunity shall be afforded the opportunity all parties to be represented by legal counsel and to respond and present evidence on all issues involved. All parties who are natural persons may act pro se and all parties who are a partnership, corporation, association, governmental subdivision, public or private organization of any character, trust, or firm may be represented by an officer, director, or employee of such entity;"

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
