BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend an Act providing for the Magistrate Court of Cobb County, approved March
24, 1988 (Ga. L. 1988, p. 4451), as amended, so as to provide for the collection
of law library fees; to provide for related matters; to repeal conflicting laws;
and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
An
Act providing for the Magistrate Court of Cobb County, approved March 24, 1988
(Ga. L. 1988, p. 4451), as amended, is amended by adding a new section to read
as follows:
"Section
2A.
In
addition to all other legal costs, a fee not to exceed $5.00 shall be charged
and collected as law library fees for each case filed in the Magistrate Court of
Cobb County. The chief magistrate or, if so designated by the chief magistrate,
the clerk of the magistrate court shall collect the law library fees authorized
by this section and shall remit such fees to the treasurer of the board of
trustees of the Cobb County law library on or before the tenth day of the month
immediately following the month in which such fees are collected. The amount of
such fees shall be determined by the chief judge of the Superior Court of Cobb
County. As used in this section, the term 'case' means any civil or criminal
matter which is docketed upon the official docket of the Magistrate Court of
Cobb County and to which a number is assigned whether such matter is consented
or not."
SECTION
2.
This
Act shall become effective on the first day of the month following the month in
which it is approved by the Governor or becomes law without such
approval.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
