Florida Senate - 2022 (PROPOSED BILL) SPB 7032 FOR CONSIDERATION By the Committee on Criminal Justice 591-01831-22 20227032pb 1 A bill to be entitled 2 An act relating to a review under the Open Government 3 Sunset Review Act; amending s. 119.071, F.S., which 4 provides an exemption from public records requirements 5 for criminal intelligence information or criminal 6 investigative information that reveals the personal 7 identifying information of a witness to a murder; 8 removing the scheduled repeal of the exemption; 9 providing an effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Paragraph (m) of subsection (2) of section 14 119.071, Florida Statutes, is amended to read: 15 119.071 General exemptions from inspection or copying of 16 public records.— 17 (2) AGENCY INVESTIGATIONS.— 18 (m)1.Criminal intelligence information or criminal 19 investigative information that reveals the personal identifying 20 information of a witness to a murder, as described in s. 782.04, 21 is confidential and exempt from s. 119.07(1) and s. 24(a), Art. 22 I of the State Constitution for 2 years after the date on which 23 the murder is observed by the witness. A criminal justice agency 24 may disclose such information: 25 1.a.In the furtherance of its official duties and 26 responsibilities. 27 2.b.To assist in locating or identifying the witness if 28 the agency believes the witness to be missing or endangered. 29 3.c.To another governmental agency for use in the 30 performance of its official duties and responsibilities. 31 4.d.To the parties in a pending criminal prosecution as 32 required by law. 332. This paragraph is subject to the Open Government Sunset34Review Act in accordance with s. 119.15 and shall stand repealed35on October 2, 2022, unless reviewed and saved from repeal36through reenactment by the Legislature.37 Section 2. This act shall take effect October 1, 2022.
