ENROLLED 2013 Legislature CS for SB 1768 20131768er 1 2 An act relating to a review under the Open Government 3 Sunset Review Act; amending s. 119.071, F.S., relating 4 to an exemption from public records requirements for 5 personal identifying information of an applicant or 6 recipient of paratransit services; making clarifying 7 changes; saving the exemption from repeal under the 8 Open Government Sunset Review Act; providing an 9 effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Paragraph (h) of subsection (5) of section 14 119.071, Florida Statutes, is amended to read: 15 119.071 General exemptions from inspection or copying of 16 public records.— 17 (5) OTHER PERSONAL INFORMATION.— 18 (h)1. Personal identifying information of an applicant for 19 or a recipient of paratransit services which is held by an 20 agency is confidential and exempt from s. 119.07(1) and s. 21 24(a), Art. I of the State Constitution. 22 2. This exemption applies to personal identifying 23 information of an applicant for or a recipient of paratransit 24 services which is held by an agency before, on, or after the 25 effective date of this exemption. 26 3. Confidential and exempt personal identifying information 27 shall be disclosed: 28 a. With the express written consent of the applicant or 29 recipientindividualor theindividual’slegally authorized 30 representative of such applicant or recipient; 31 b. In a medical emergency, but only to the extent that is 32 necessary to protect the health or life of the applicant or 33 recipientindividual; 34 c. By court order upon a showing of good cause; or 35 d. To another agency in the performance of its duties and 36 responsibilities. 374. This paragraph is subject to the Open Government Sunset38Review Act in accordance with s.119.15, and shall stand39repealed on October 2, 2013, unless reviewed and saved from40repeal through reenactment by the Legislature.41 Section 2. This act shall take effect October 1, 2013.
