    1                        A bill to be entitled                      
    2         An act relating to autonomous practice by advanced
    3         practice registered nurses; amending s. 464.0123,
    4         F.S.; requiring certified nurse midwives providing
    5         out-of-hospital birth services to have a written plan
    6         for the appropriate delivery of emergency care;
    7         providing requirements for the plan; deleting a
    8         requirement that certified nurse midwives have a
    9         written patient transfer agreement with a hospital and
   10         a written referral agreement with a licensed
   11         physician; providing an effective date.

   13  Be It Enacted by the Legislature of the State of Florida:
   14  
   15         Section 1. Paragraph (b) of subsection (3) of section
   16  464.0123, Florida Statutes, is amended to read:
   17         464.0123 Autonomous practice by an advanced practice
   18  registered nurse.—
   19         (3) PRACTICE REQUIREMENTS.—
   20         (b) A certified nurse midwife providing out-of-hospital
   21  birth services must have a written plan for the appropriate
   22  delivery of emergency care. A copy of the plan must be
   23  maintained on file and must include all of the following:
   24         1.The name and address of the closest hospital.
   25         2.Reasons for which an emergency transfer may be required.
   26         3.Emergency medical services to be used in the event of an
   27  emergency patient transfer agreement with a hospital and a
   28  written referral agreement with a physician licensed under
   29  chapter 458 or chapter 459 to engage in nurse midwifery.
   30         Section 2. This act shall take effect July 1, 2022.
