1                        A bill to be entitled 
2         An act relating to trust funds; creating s. 16.558, 
3         F.S.; creating the Federal Law Enforcement Trust Fund 
4         within the Department of Legal Affairs; providing 
5         sources of funds; exempting the trust fund from a 
6         service charge; providing for future review and 
7         termination or re-creation of the trust fund; 
8         providing a contingent effective date.

10  Be It Enacted by the Legislature of the State of Florida: 
11 
12         Section 1. Section 16.558, Florida Statutes, is created to 
13  read: 
14         16.558 Federal Law Enforcement Trust Fund.— 
15         (1) The Federal Law Enforcement Trust Fund is created 
16  within the Department of Legal Affairs. The department may 
17  deposit into the trust fund receipts and revenues received as a 
18  result of federal criminal, administrative, or civil forfeiture 
19  proceedings and receipts and revenues received from federal 
20  asset-sharing programs. The trust fund is exempt from the 
21  service charge imposed by s. 215.20. 
22         (2) In accordance with s. 19(f)(2), Art. III of the State 
23  Constitution, the Federal Law Enforcement Trust Fund shall, 
24  unless terminated sooner, be terminated on July 1, 2014. Before 
25  its scheduled termination, the trust fund shall be reviewed as 
26  provided in s. 215.3206(1) and (2). 
27         Section 2. This act shall take effect July 1, 2010, but 
28  this act shall not take effect unless it is enacted by a three 
29  fifths vote of the membership of each house of the Legislature.
