Florida Senate - 2011 SB 1604 By Senator Siplin 19-01592-11 20111604__ 1 A bill to be entitled 2 An act relating to identification cards; amending s. 3 322.051, F.S.; providing that a Department of 4 Corrections original certificate of identification or 5 valid identification card is satisfactory proof of 6 identity in order to be issued an identification card 7 by the Department of Highway Safety and Motor 8 Vehicles; providing an effective date. 9 10 Be It Enacted by the Legislature of the State of Florida: 11 12 Section 1. Paragraph (a) of subsection (1) of section 13 322.051, Florida Statutes, is amended to read: 14 322.051 Identification cards.— 15 (1) Any person who is 5 years of age or older, or any 16 person who has a disability, regardless of age, who applies for 17 a disabled parking permit under s. 320.0848, may be issued an 18 identification card by the department upon completion of an 19 application and payment of an application fee. 20 (a) Each such application shall include the following 21 information regarding the applicant: 22 1. Full name (first, middle or maiden, and last), gender, 23 proof of social security card number satisfactory to the 24 department, county of residence, mailing address, proof of 25 residential address satisfactory to the department, country of 26 birth, and a brief description. 27 2. Proof of birth date satisfactory to the department. 28 3. Proof of identity satisfactory to the department. Such 29 proof must include one of the following documents issued to the 30 applicant: 31 a. A driver’s license record or identification card record 32 from another jurisdiction that required the applicant to submit 33 a document for identification which is substantially similar to 34 a document required under sub-subparagraph b., sub-subparagraph 35 c., sub-subparagraph d., sub-subparagraph e., sub-subparagraph 36 f., sub-subparagraph g., or sub-subparagraph h.; 37 b. A certified copy of a United States birth certificate; 38 c. A valid, unexpired United States passport; 39 d. A naturalization certificate issued by the United States 40 Department of Homeland Security; 41 e. A valid, unexpired alien registration receipt card 42 (green card); 43 f. A Consular Report of Birth Abroad provided by the United 44 States Department of State; 45 g. A Department of Corrections original certificate of 46 identification or valid identification card; 47 h.g.An unexpired employment authorization card issued by 48 the United States Department of Homeland Security; or 49 i.h.Proof of nonimmigrant classification provided by the 50 United States Department of Homeland Security, for an original 51 identification card. In order to prove such nonimmigrant 52 classification, applicants may produce but are not limited to 53 the following documents: 54 (I) A notice of hearing from an immigration court 55 scheduling a hearing on any proceeding. 56 (II) A notice from the Board of Immigration Appeals 57 acknowledging pendency of an appeal. 58 (III) Notice of the approval of an application for 59 adjustment of status issued by the United States Bureau of 60 Citizenship and Immigration Services. 61 (IV) Any official documentation confirming the filing of a 62 petition for asylum or refugee status or any other relief issued 63 by the United States Bureau of Citizenship and Immigration 64 Services. 65 (V) Notice of action transferring any pending matter from 66 another jurisdiction to Florida, issued by the United States 67 Bureau of Citizenship and Immigration Services. 68 (VI) Order of an immigration judge or immigration officer 69 granting any relief that authorizes the alien to live and work 70 in the United States including, but not limited to asylum. 71 (VII) Evidence that an application is pending for 72 adjustment of status to that of an alien lawfully admitted for 73 permanent residence in the United States or conditional 74 permanent resident status in the United States, if a visa number 75 is available having a current priority date for processing by 76 the United States Bureau of Citizenship and Immigration 77 Services. 78 (VIII) On or after January 1, 2010, an unexpired foreign 79 passport with an unexpired United States Visa affixed, 80 accompanied by an approved I-94, documenting the most recent 81 admittance into the United States. 82 83 Presentation of any of the documents described in sub 84 subparagraph h.g.or sub-subparagraph i.h.entitles the 85 applicant to an identification card for a period not to exceed 86 the expiration date of the document presented or 1 year, 87 whichever first occurs. 88 Section 2. This act shall take effect July 1, 2011.
