    2         An act relating to automated license plate recognition
    3         systems; amending s. 316.0778, F.S.; prohibiting
    4         homeowners’ associations from owning or operating an
    5         automated license plate recognition system; providing
    6         an effective date.

    8  Be It Enacted by the Legislature of the State of Florida:
    9  
   10         Section 1. Section 316.0778, Florida Statutes, is amended
   11  to read:
   12         316.0778 Automated license plate recognition systems;
   13  prohibited uses; records retention.—
   14         (1) As used in this section, the term “automated license
   15  plate recognition system” means a system of one or more mobile
   16  or fixed high-speed cameras combined with computer algorithms to
   17  convert images of license plates into computer-readable data.
   18         (2) An automated license plate recognition system may not
   19  be owned or operated by a homeowners’ association as defined in
   20  s. 720.301(9).
   21         (3) In consultation with the Department of Law Enforcement,
   22  the Department of State shall establish a retention schedule for
   23  records containing images and data generated through the use of
   24  an automated license plate recognition system. The retention
   25  schedule must establish a maximum period that the records may be
   26  retained.
   27         Section 2. This act shall take effect July 1, 2020.
