    1                        A bill to be entitled                      
    2         An act relating to workforce education postsecondary
    3         student fees; amending ss. 1009.22 and 1009.23, F.S.;
    4         authorizing district school boards and Florida College
    5         System institutions’ boards of trustees, in
    6         consultation with certain organizations, to implement
    7         a plan for a differential out-of-state fee for
    8         specified purposes; requiring school districts and
    9         Florida College System institutions to prioritize the
   10         enrollment of certain students in specified programs
   11         of study; providing reporting requirements; providing
   12         an effective date.

   14  Be It Enacted by the Legislature of the State of Florida:
   15  
   16         Section 1. Subsection (4) of section 1009.22, Florida
   17  Statutes, is amended to read:
   18         1009.22 Workforce education postsecondary student fees.—
   19         (4)(a) A district school board or Florida College System
   20  institution board of trustees that has a service area that
   21  borders another state may implement a plan for a differential
   22  out-of-state fee.
   23         (b) A district school board or Florida College System
   24  institution board of trustees, in consultation with regional
   25  workforce and economic development organizations, may implement
   26  a plan for a differential out-of-state fee for the purpose of
   27  recruiting students into programs of study identified as
   28  necessary to address unmet current and future workforce needs in
   29  the region as identified by the Labor Market Estimating
   30  Conference created in s. 216.136 or the Credentials Review
   31  Committee established in s. 445.004. A school district or
   32  Florida College System institution shall prioritize the
   33  enrollment of a resident student in the identified programs of
   34  study over an out-of-state student. A district school board or
   35  Florida College System institution board of trustees shall
   36  annually provide a report to the State Board of Education on the
   37  employment outcomes of the students who receive a differential
   38  out-of-state fee. The report must include the percentage of such
   39  students who are employed in the occupations identified as
   40  having unmet current and future workforce needs.
   41         Section 2. Present paragraph (b) of subsection (6) of
   42  section 1009.23, Florida Statutes, is redesignated as paragraph
   43  (c), and a new paragraph (b) is added to that subsection, to
   44  read:
   45         1009.23 Florida College System institution student fees.—
   46         (6)
   47         (b) A Florida College System institution board of trustees,
   48  in consultation with regional workforce and economic development
   49  organizations, may implement a plan for a differential out-of
   50  state fee for the purpose of recruiting students into programs
   51  of study identified as necessary to address unmet current and
   52  future workforce needs in the region as identified by the Labor
   53  Market Estimating Conference created in s. 216.136 or the
   54  Credentials Review Committee established in s. 445.004. A
   55  Florida College System institution shall prioritize the
   56  enrollment of a resident student in the identified programs of
   57  study over an out-of-state student. A Florida College System
   58  institution board of trustees shall annually provide a report to
   59  the State Board of Education on the employment outcomes of the
   60  students who receive a differential out-of-state fee. The report
   61  must include the percentage of such students who are employed in
   62  the occupations identified as having unmet current and future
   63  workforce needs.
   64         Section 3. This act shall take effect July 1, 2022.
