    2         An act relating to airport parking fees; amending s.
    3         316.1964, F.S.; exempting vehicles transporting power
    4         mobility devices for use by persons who have a
    5         disability from payment of parking fees at a publicly
    6         owned or operated airport; providing an effective
    7         date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Subsection (7) of section 316.1964, Florida
   12  Statutes, is amended to read:
   13         316.1964 Exemption of vehicles transporting certain persons
   14  who have disabilities from payment of parking fees and
   15  penalties.—
   16         (7) An airport that owns, operates, or leases parking
   17  facilities, or any other parking facilities that are used for
   18  the purpose of air travel, may charge for parking vehicles that
   19  display a disabled parking permit or license tag issued under s.
   20  316.1958, s. 320.084, s. 320.0842, s. 320.0843, s. 320.0845, or
   21  s. 320.0848. However, the governing body of each publicly owned
   22  or publicly operated airport must grant free parking to any
   23  vehicle with specialized equipment, such as ramps, lifts, or
   24  foot or hand controls, or attachments to transport power
   25  mobility devices, as defined in 42 C.F.R. s. 410.38, or for use
   26  utilization by a person who has a disability or whose vehicle is
   27  displaying the Florida Toll Exemption permit.
   28         Section 2. This act shall take effect July 1, 2012.
