Florida Senate - 2011 SB 570 By the Committee on Judiciary 590-00698-11 2011570__ 1 A bill to be entitled 2 An act relating to a review under the Open Government 3 Sunset Review Act; amending s. 787.03, F.S., relating 4 to a public-records exemption for information 5 submitted to a sheriff or state attorney for the 6 purpose of obtaining immunity from prosecution for the 7 offense of interference with custody; saving the 8 exemption from repeal under the Open Government Sunset 9 Review Act; deleting a provision providing for the 10 repeal of the exemption; providing an effective date. 11 12 Be It Enacted by the Legislature of the State of Florida: 13 14 Section 1. Paragraph (c) of subsection (6) of section 15 787.03, Florida Statutes, is amended to read: 16 787.03 Interference with custody.— 17 (6) 18 (c)1. The current address and telephone number of the 19 person and the minor or incompetent person which are contained 20 in the report made to a sheriff or state attorney under 21 paragraph (b) are confidential and exempt from s. 119.07(1) and 22 s. 24(a), Art. I of the State Constitution. 23 2. A sheriff or state attorney may allow an agency, as 24 defined in s. 119.011, to inspect and copy records made 25 confidential and exempt under this paragraph in the furtherance 26 of that agency’s duties and responsibilities. 273. This paragraph is subject to the Open Government Sunset28Review Act in accordance with s.119.15and is repealed on29October 2, 2011, unless reviewed and saved from repeal through30reenactment by the Legislature.31 Section 2. This act shall take effect October 1, 2011.
