1                        A bill to be entitled 
2         An act relating to the solicitation of funds; amending 
3         s. 496.406, F.S.; exempting certain veterans’ 
4         organizations from requirements to file registration 
5         statements with the Department of Agriculture and 
6         Consumer Services; providing an effective date.

8  Be It Enacted by the Legislature of the State of Florida: 
9 
10         Section 1. Section 496.406, Florida Statutes, is amended to 
11  read: 
12         496.406 Exemption from registration.—The following 
13  charitable organizations and sponsors are exempt from the 
14  requirements of s. 496.405: 
15         (1) A person who is soliciting for a named individual, 
16  provided that all the contributions collected without any 
17  deductions whatsoever are turned over to the beneficiary for her 
18  or his use and provided that the person has complied with the 
19  requirements of s. 496.413. 
20         (2) A charitable organization or sponsor which limits 
21  solicitation of contributions to the membership of the 
22  charitable organization or sponsor. For the purposes of this 
23  paragraph, the term “membership” does not include those persons 
24  who are granted a membership upon making a contribution as a 
25  result of a solicitation. 
26         (3) A reputable military veterans’ association or 
27  organization that is registered with the Department of Veterans’ 
28  Affairs. 
29         Section 2. This act shall take effect July 1, 2010.
