    1                        A bill to be entitled                      
    2         An act relating to controlled substances; defining
    3         terms; requiring a person who knows, or has reasonable
    4         cause to suspect, that a health care practitioner who
    5         prescribes or dispenses controlled substances is
    6         stealing or abusing controlled substances that have
    7         been prescribed or dispensed for another to report
    8         such knowledge or suspicion to a law enforcement
    9         agency; providing an effective date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. (1) As used in this section, the term:
   14         (a) “Controlled substance” means a controlled substance
   15  listed in Schedule II, Schedule III, or Schedule IV in s.
   16  893.03, Florida Statutes.
   17         (b) “Health care practitioner” means any practitioner who
   18  is subject to licensure or regulation by the Department of
   19  Health under chapter 458, chapter 459, chapter 461, chapter 462,
   20  chapter 464, chapter 465, or chapter 466.
   21         (c) “Law enforcement agency” means the Department of Law
   22  Enforcement, a Florida sheriff’s department, a Florida police
   23  department, or a law enforcement agency of the Federal
   24  Government which enforces the laws of this state or the United
   25  States relating to controlled substances and whose agents and
   26  officers are empowered by law to conduct criminal investigations
   27  and make arrests.
   28         (2) A person who knows, or has reasonable cause to suspect,
   29  that a health care practitioner who prescribes or dispenses
   30  controlled substances is stealing or abusing controlled
   31  substances that have been prescribed or dispensed for another
   32  shall report such knowledge or suspicion to a law enforcement
   33  agency.
   34         Section 2. This act shall take effect July 1, 2011.
