A bill to be entitled
2An act relating to the Florida Endowment for Vocational
3Rehabilitation; amending s. 413.615, F.S.; removing a
4provision that requires the State Board of Administration
5to invest and reinvest moneys in the endowment fund for
6the Florida Endowment for Vocational Rehabilitation;
7requiring that a specified percentage of the remainder of
8all civil penalties received by a county court pursuant to
9ch. 318, F.S., be remitted to the Department of Revenue on
10a monthly basis for deposit in the endowment fund;
11requiring that a specified percentage of the additional
12fine assessed for violating traffic regulations protecting
13mobility-impaired persons be remitted to the Department of
14Revenue on a monthly basis for deposit in the endowment
15fund; amending s. 318.18, F.S.; conforming a provision to
16changes made by the act; providing an effective date.

18Be It Enacted by the Legislature of the State of Florida:

20 Section 1. Subsection (4) of section 413.615, Florida
21Statutes, is amended to read:
22 413.615 Florida Endowment for Vocational Rehabilitation.-
23 (4) REVENUE FOR THE ENDOWMENT FUND.-
24 (a) The endowment fund of the Florida Endowment for
25Vocational Rehabilitation is created as a long-term, stable, and
26growing source of revenue to be administered, in accordance with
27rules promulgated by the division, by the foundation as a
28direct-support organization of the division.
29 (b) The principal of the endowment fund shall derive from
30the deposits made pursuant to s. 318.21(2)(e), together with any
31legislative appropriations which may be made to the endowment,
32and such bequests, gifts, grants, and donations as may be
33solicited for such purpose by the foundation from public or
34private sources.
35 (c) Two percent of the remainder of all civil penalties
36received by a county court pursuant to chapter 318 shall be
37remitted to the Department of Revenue on a monthly basis for
38deposit in the endowment fund. Sixty percent of the additional
39fine assessed under s. 318.18(3)(f) for a violation of s.
40316.1303 must be remitted to the Department of Revenue on a
41monthly basis for deposit in the endowment fund and 40 percent
42must be distributed pursuant to s. 318.21(1) and (2). The State
43Board of Administration shall invest and reinvest moneys of the
44endowment fund in accordance with the provisions of ss. 215.44-
45215.53. Moneys in the endowment fund in excess of the endowment
46fund principal, or such lesser amount as may be requested in
47writing by the foundation, shall be annually transmitted to the
48foundation, based upon a fiscal year which shall run from July 1
49through June 30, and shall be deposited in the foundation's
50operating account, for distribution as provided in subsection
51(10). The endowment fund principal shall be $1 million for the
522000-2001 fiscal year and shall be increased by 5 percent in
53each subsequent fiscal year.
54 (d) The board of directors of the foundation shall
55establish the operating account and shall deposit therein the
56moneys transmitted pursuant to paragraph (c). Moneys in the
57operating account shall be available to carry out the purposes
58of subsection (10).
59 Section 2. Paragraph (f) of subsection (3) of section
60318.18, Florida Statutes, is amended to read:
61 318.18 Amount of penalties.-The penalties required for a
62noncriminal disposition pursuant to s. 318.14 or a criminal
63offense listed in s. 318.17 are as follows:

65 (f) If a violation of s. 316.1301 or s. 316.1303 results
66in an injury to the pedestrian or damage to the property of the
67pedestrian, an additional fine of up to $250 shall be paid.
68Except as provided in s. 413.615(4)(c), this amount must be
69distributed pursuant to s. 318.21.
70 Section 3. This act shall take effect July 1, 2010.
