14 | requirements; requiring a report to the Legislature; |
15 | requiring the use of the protocols and procedures |
16 | following legislative approval until such approval is |
17 | affirmatively revoked; amending s. 216.133, F.S.; |
18 | conforming a cross-reference to changes made by the act; |
19 | providing an effective date. |

21 | Be It Enacted by the Legislature of the State of Florida: |
22 | |
23 | Section 1. Section 216.138, Florida Statutes, is created |
24 | to read: |
25 | 216.138 Authority to request additional analysis of |
26 | legislation.-The President of the Senate or the Speaker of the |
27 | House of Representatives may request special impact sessions of |
28 | consensus estimating conferences to evaluate proposed |
29 | legislation based on tools and models not generally employed by |
30 | the conferences, including cost-benefit, return-on-investment, |
31 | or dynamic scoring techniques, when suitable and appropriate for |
32 | the legislation being evaluated. Unless exempt from s. |
33 | 119.07(1), information used to develop the analyses shall be |
34 | available to the public. |
35 | Section 2. The Office of Economic and Demographic |
36 | Research, acting in consultation with the principals of the |
37 | consensus estimating conferences and after receiving public |
38 | input, shall develop protocols and procedures necessary to |
39 | implement s. 216.138, Florida Statutes. At a minimum, the |
40 | protocols and procedures to be used for evaluating specific |
41 | proposed legislation shall include cost-benefit, return-on- |
42 | investment, and dynamic scoring techniques and may include |
43 | additional, appropriate economic techniques. Additionally, the |
44 | protocols and procedures must address the format for reporting |
45 | results and provide proposed linkages to the appropriations and |
46 | revenue forecasting processes, including any statutory changes |
47 | that may be needed. The linkages must be consistent with the |
48 | constitutional requirement for a balanced budget. The office |
49 | shall submit a report of its findings and recommendations to the |
50 | President of the Senate and the Speaker of the House of |
51 | Representatives by December 1, 2010. Subject to approval by the |
52 | President of the Senate and the Speaker of the House of |
53 | Representatives following the submission of the report, the |
54 | protocols and procedures shall be used to the extent feasible |
55 | for the analysis of specific proposed legislation by consensus |
56 | estimating conferences as provided in s. 216.138, Florida |
57 | Statutes, unless and until such approval is subsequently |
58 | affirmatively revoked. |
59 | Section 3. Section 216.133, Florida Statutes, is amended |
60 | to read: |

63 | (1) "Consensus estimating conference" includes the |
64 | Economic Estimating Conference, the Demographic Estimating |
65 | Conference, the Revenue Estimating Conference, the Education |
66 | Estimating Conference, the Criminal Justice Estimating |
67 | Conference, the Occupational Forecasting Conference, the Early |
68 | Learning Programs Estimating Conference, the Self-Insurance |
69 | Estimating Conference, the Florida Retirement System Actuarial |
70 | Assumption Conference, and the Social Services Estimating |
71 | Conference. |
72 | (2) "Official information" means the data, forecasts, |
73 | estimates, analyses, studies, and other information which the |
74 | principals of a consensus estimating conference unanimously |
75 | adopt for purposes of the state planning and budgeting system. |
76 | (3) "Consensus" means the unanimous consent of all of the |
77 | principals of a consensus estimating conference. |
78 | Section 4. This act shall take effect upon becoming a law. |
