       Senator Hooper moved the following:
       
    1         Senate Substitute for Amendment (202390) (with title
    2  amendment)
    3  
    4         Delete lines 37 - 39
    5  and insert:
    6  information.
    7         3.A law enforcement agency shall disclose law enforcement
    8  geolocation information in the following instances:
    9         a.Upon a request from a state or federal law enforcement
   10  agency;
   11         b.When a person files a petition with the circuit court in
   12  the jurisdiction where the agency having custody of the
   13  requested law enforcement geolocation information is located
   14  specifying the reasons for requesting such information and the
   15  court, upon a showing of good cause, issues an order authorizing
   16  the release of the law enforcement geolocation information. In
   17  all cases in which the court releases law enforcement
   18  geolocation information under this sub-subparagraph, such
   19  information must be viewed or copied under the direct
   20  supervision of the custodian of the record or his or her
   21  designee; or
   22         c.When law enforcement geolocation information is
   23  requested for use in a criminal, civil, or administrative
   24  proceeding. This sub-subparagraph does not prohibit a court in
   25  such a criminal, civil, or administrative proceeding, upon a
   26  showing of good cause, from restricting or otherwise controlling
   27  the disclosure of such information.
