House . . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— Senator Sobel moved the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 650 - 666 4 and insert: 5 must be updated at least annually. 6 (3) The department shall include in contracts with managing 7 entities and mental health services providers provisions that 8 require the provider to assign a case manager; provide emergency 9 psychiatric care; establish a detailed protocol for the 10 supervision of the clinical needs of the residents; provide 11 services during evenings, weekends, and holidays; prepare a 12 community living support plan; execute a cooperative agreement 13 before providing services; and implement the requirements of 14 this section for state-funded residents who reside in an 15 assisted living facility that holds a limited mental health 16 license. The department shall establish performance measures for 17 mental health services provided to state-funded residents of 18 assisted living facilities and report performance on an annual 19 basis pursuant to s. 216.013. The department shall adopt rules 20 relating to procedures and penalties to administer this section. 21 (4) The Agency for Health Care Administration shall include 22 in contracts with Medicaid reform plans, prepaid mental health 23 plans, and managed care contract providers a requirement that 24 residents have an assigned case manager; have services during 25 evenings, weekends, and holidays; have emergency psychiatric 26 care when needed; and have a detailed protocol that explains how 27 the provider will ensure appropriate supervision of the clinical 28 needs of Medicaid-eligible individuals who reside in an assisted 29 living facility that holds a limited mental health license. The 30 agency shall require Medicaid managed care plans and prepaid 31 mental health plans to establish performance measures for mental 32 health services provided to state-funded residents of assisted 33 living facilities and to report performance on an annual basis 34 to the agency. The agency shall adopt rules relating to 35 procedures and penalties to administer this section. 36 (5) The department shall enter into an interagency 37 agreement with the Agency for Health Care Administration which 38 delineates their respective responsibilities and procedures for 39 enforcing the requirements of this section relating to 40 regulatory oversight of the needs of mental health residents who 41 reside in assisted living facilities and contracted mental 42 health providers. 43 (6)(3)The Secretary of Children and Family Services, in 44 45 ================= T I T L E A M E N D M E N T ================ 46 And the title is amended as follows: 47 Delete lines 32 - 48 48 and insert: 49 mental health resident’s admission; requiring the 50 Department of Children and Families to include 51 specific provisions relating to the protection of 52 residents in contracts with managing entities and 53 mental health services providers; requiring the 54 department to establish and report performance 55 measures for mental health services provided to state 56 funded residents in assisted living facilities; 57 requiring the Agency for Health Care Administration to 58 include specific provisions relating to the protection 59 of residents in contracts with certain Medicaid plans, 60 mental health plans, and managed care contract 61 providers; requiring the department and the agency to 62 enter into an interagency agreement relating to their 63 respective responsibilities and procedures to enforce 64 provisions relating to mental health residents in 65 regulated facilities; amending s. 394.741, F.S.; 66 revising
