       Senator Gibson moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 650 - 666
    4  and insert:
    5  must be updated at least annually.
    6         (3) The department shall include in contracts with managing
    7  entities and mental health services providers provisions that
    8  require the provider to assign a case manager; provide emergency
    9  psychiatric care; establish a detailed protocol for the
   10  supervision of the clinical needs of the residents; provide
   11  services during evenings, weekends, and holidays; prepare a
   12  community living support plan; execute a cooperative agreement
   13  before providing services; and implement the requirements of
   14  this section for state-funded residents that reside in an
   15  assisted living facility that holds a limited mental health
   16  license. The department shall establish and impose contract
   17  penalties for managing entities and mental health service
   18  providers under contract with the department that do not comply
   19  with this section. The department shall adopt rules relating to
   20  procedures and penalties to administer this section.
   21         (4) The Agency for Health Care Administration shall include
   22  in contracts with Medicaid reform plans, prepaid mental health
   23  plans, and managed care contract providers a requirement that
   24  residents have an assigned mental health case manager; have
   25  services during evenings, weekends, and holidays; have emergency
   26  psychiatric care when needed; and have a detailed protocol that
   27  explains how the provider will ensure appropriate supervision of
   28  the clinical needs of Medicaid-eligible individuals that reside
   29  in an assisted living facility that holds a limited mental
   30  health license. The agency shall impose penalties for managed
   31  care organizations that do not comply with this section. The
   32  agency shall adopt rules relating to procedures and penalties to
   33  administer this section.
   34         (5) The department shall enter into an interagency
   35  agreement with the Agency for Health Care Administration that
   36  delineates their respective responsibilities and procedures for
   37  enforcing the requirements of this section relating to
   38  regulatory oversight and the needs of mental health residents
   39  that reside in assisted living facilities and contracted mental
   40  health providers.
   41         (6)(3) The Secretary of Children and Family Services, in

   44         And the title is amended as follows:
   45         Delete lines 32 - 48
   46  and insert:
   47         mental health resident’s admission; requiring the
   48         Department of Children and Families to include
   49         specific provisions relating to the protection of
   50         residents in contracts with managing entities and
   51         mental health services providers; requiring the Agency
   52         for Health Care Administration to include specific
   53         provisions relating to the protection of residents in
   54         contracts with certain Medicaid plans, mental health
   55         plans, and managed care contract providers; requiring
   56         the department and the agency to enter into an
   57         interagency agreement relating to their respective
   58         responsibilities and procedures to enforce provisions
   59         relating to mental health residents in regulated
   60         facilities; amending s. 394.741, F.S.; revising
