       Senator Brandes moved the following:
       
    1         Senate Amendment (with title amendment)

    3         Before line 349
    4  insert:
    5         Section 4. Section 631.65, Florida Statutes, is amended to
    6  read:
    7         631.65 Prohibited Advertisement or solicitation.—No person
    8  shall make, publish, disseminate, circulate, or place before the
    9  public, or cause, directly or indirectly, to be made, published,
   10  disseminated, circulated, or placed before the public, in a
   11  newspaper, magazine, or other publication, or in the form of a
   12  notice, circular, pamphlet, letter, or poster, or over any radio
   13  station or television station, or in any other way, any An
   14  advertisement or a solicitation that, announcement, or statement
   15  which uses the existence of the insurance guaranty association
   16  for the purpose of sales, solicitation, or inducement to
   17  purchase any form of insurance covered under this part must
   18  explain the coverage limits of the association set forth in s.
   19  631.57(1) which apply to the type of insurance described in the
   20  advertisement or solicitation. However, this section does not
   21  prohibit a duly licensed insurance agent from explaining the
   22  existence or function of the insurance guaranty association to
   23  policyholders, prospects, or applicants for coverage.

   26  And the title is amended as follows:
   27         Delete line 18
   28  and insert:
   29         prohibiting their inclusion in rates; amending s.
   30         631.65, F.S.; authorizing, rather than prohibiting, an
   31         advertisement or a solicitation to use the existence
   32         of the association to sell, solicit, or induce the
   33         purchase certain insurance if the advertisement or
   34         solicitation explains specified coverage limits of the
   35         association; amending ss.
