SENATE CONCURRENT RESOLUTION NO. 34

ESTABLISHING A STATE TRANSITION TASK FORCE FOR EMERGING ADULTS WITH DISABILITIES AND SPECIAL HEALTH CARE NEEDS.



WHEREAS, disabilities and special health care needs are a natural part of human life and the presence of a disability or special health care need does not diminish a person's right to a balanced, healthy and productive lifestyle;

WHEREAS, the public interest would be best served by a broad array of transitional services that would support children and youth with disabilities or special health care needs at home or in the community and that promote individual autonomy, dignity and choice;

WHEREAS, it is the intent of the General Assembly that a task force of qualified persons study the transitional needs of children and youth with disabilities and special health care needs and develop strategies to ensure successful transition from childhood and adolescent services into adult services;

NOW, THEREFORE:

BE IT RESOLVED by the Senate of the 146th General Assembly of the State of Delaware, the House of Representatives concurring therein, that there is established a State Transition Task Force for Emerging Adults with Disabilities and Special Health Care Needs (the "Task Force").The Governor's Advisory Council for Exceptional Citizens ("GACEC"), with research support from the Center for Disabilities Studies at the University of Delaware and the Catalyst Center: Improving Financing of Care for Children and Youth with Special Health Care Needs at the Boston University School of Public Health ("The Catalyst Center") shall create the Task Force.

BE IT FURTHER RESOLVED that the Task Force shall consist of the following members:

(1) The Executive Director and Council Chairperson of the GACEC or designees thereof who shall be the Co-Chairpersons of the Task Force;

(2)The Director of the Division of Public Health or a designee thereof;

(3)A representative from the children health care medical community;

(4)A representative from the adult health care medical community;

(5)A representative from the Disabilities Law Program;

(6)A representative from Delaware's Independent Living Centers;

(7)The Chairperson of the State Council for Persons with Disabilities or a designee thereof;

(8)The Chairperson of the Developmental Disabilities Council or a designee thereof;

(9)The President of the Parent Information Center or a designee thereof;

(10)The Director of Delaware Family Voices or a designee thereof;

(11)Three young adults who have disabilities or special health care needs;

(12) Three family members of young adults who have disabilities or special health care needs;

(13)The Secretary of Labor or a designee thereof;

(14)The Secretary of Education or a designee thereof;

(15)The Secretary of Health and Social Services or a designee thereof;

(16)The Secretary of the Department of Services for Children, Youth and Their Families or a designee thereof;

(17)A person appointed by the President pro tempore of the Senate;

(18)A person appointed by the Speaker of the House of Representatives;

(19)A representative from the Center for Disabilities Studies at the University of Delaware;

(20)The Insurance Commissioner or a designee thereof; and

(21)A representative from the Catalyst Center.

BE IT FURTHER RESOLVED that the members of the Task Force listed in the paragraph above shall also represent each of the three geographic areas in the State:rural, suburban and urban.

BE IT FURTHER RESOLVED that the Task Force shall include four subcommittee work groups, each of which shall address one of the four areas of housing/transportation, health care, education and employment.

BE IT FURTHER RESOLVED that the Task Force shall:

(1)Convene as soon as possible;

(2)Obtain input from key stakeholders, community stakeholders, public agencies, the medical practice community and youth who have disabilities and/or special health care needs and their families to assess the need for transition services and to identify barriers that impede access to transition services which may include health care, insurance, independent living, vocational training, post-secondary education, mental health care and employment;

(3)Develop a statewide plan to promote the development of transition services for young adults with disabilities and special health care needs. The plan should put forth different models that accommodate the geographic and cultural diversity in this State and that are adapted to the local needs of communities and to local transition services delivery systems. Furthermore, the plan should promote the integration of transition services with transition programs for education, vocation and independent living;

(4)Identify common or comparable performance measures for all entities that serve the needs for transition services of youth and young adults who have disabilities and special health care needs;

(5)Collect and disseminate information concerning best practices in transition services for youth and young adults who have disabilities and special health care needs; and

(6)Identify existing and potential funding sources to create transition services within communities.

BE IT FURTHER RESOLVED that the GACEC shall provide staff support to the Task Force. Task Force members shall serve without compensation.

BE IT FURTHER RESOLVED that the Task Force shall present a final report of its findings and recommendations to the Governor, the President pro tempore of the Senate and the Speaker of the House of Representatives by one year from the date of passage of this Resolution.
