DELAWARE STATE SENATE

145th GENERAL ASSEMBLY

SENATE BILL NO. 238

AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO VEHICULAR HOMICIDE.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1.Amend §630, Title 11, Delaware Code by deleting "class F felony" at the end of subsection (a) thereof and by inserting in lieu thereof "class D felony".

Section 2.Amend §630A, Title 11, Delaware Code by deleting "class E felony" as it appears at the end of subsection (a) thereof and by inserting in lieu thereof "class B felony".

SYNOPSIS

This Act increases the maximum jail time for vehicular homicide in the 2^nd degree from 3 years to 8 years and for vehicular homicide in the 1^st degree from 5 years to 25 years.
