DELAWARE STATE SENATE

146th GENERAL ASSEMBLY

SENATE BILL NO. 213

AN ACT TO AMEND TITLE 25 OF THE DELAWARE CODE RELATING TO MANUFACTURED HOMES.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1. Amend §7004, Title 25 of the Delaware Code by making insertions as shown by underlining as follows:

§7004

(c) The rental of ground upon which a manufactured home has been installed on a permanent foundation is exempt from the requirements of this subchapter so long as the rental agreement or lease for the ground (i) has a minimum term of 40 years, and (ii) permits increases in rent payments no more than once in any 12-month period. Nothing in this subchapter may be construed as determining, regulating or governing the legal rights of parties for the rental of ground as described in this subsection.


SYNOPSIS

The purpose of this bill is to exempt manufactured homes on permanent foundations with rental agreements or land leases at least 40 years in term and that permit rent increases no more than once a year from Chapter 70 of Title 25.
