DELAWARE STATE SENATE

145th GENERAL ASSEMBLY

SENATE BILL NO. 162

AN ACT TO AMEND TITLE 30 OF THE DELAWARE CODE RELATING TO PHARMACIES.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend Title 30, Delaware Code, by adding a new §912 to read as follows:

"§912.Additional fee on gross receipts of pharmacies not participating in Medicaid program.

(a)In addition to any other gross receipt fees assessed, there shall be an additional gross receipt license fee at the rate of 2% of the aggregate sales of all products by a pharmacy refusing to fill Medicaid prescriptions in Delaware.

(b)All funds collected pursuant to this section shall be placed in a special fund to be designated as the Medicaid Assistance Fund dedicated to offsetting State Medicaid obligations.A special fund is hereby created for that purpose."


SYNOPSIS

This Bill creates an assessment of 2% of gross receipts from any pharmacy in Delaware not participating in the Medicaid program.It requires all collected funds to be deposited in a special fund dedicated to Medicaid related expenses.
