AN ACT TO AMEND TITLE 30 OF THE DELAWARE CODE RELATING TO PHARMACIES. |
Section 1.Amend Title 30, Delaware Code, by adding a new §912 to read as follows:
"§912.Additional fee on gross receipts of pharmacies not participating in Medicaid program.
(a)In addition to any other gross receipt fees
assessed, there shall be an additional gross receipt license fee at the rate of
2% of the aggregate sales of all products by a pharmacy refusing to fill
Medicaid prescriptions in
(b)All funds collected pursuant to this section shall be placed in a special fund to be designated as the Medicaid Assistance Fund dedicated to offsetting State Medicaid obligations.A special fund is hereby created for that purpose."
