HOUSE BILL NO. 65

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATED TO STATE GOVERNMENT AND THE GENERAL ASSEMBLY.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend Chapter 7, Title 29 of the Delaware Code by adding a new §712 as follows:

"§ 712.Members of the General Assembly prohibited from becoming employed by the State of Delaware.

A member of the General Assembly may not be employed by the State of Delaware while serving in the General Assembly, unless the member was already a state employee at the time the member was elected to the General Assembly.For purposes of this section, service in the General Assembly itself shall not be construed as employment by the State of Delaware.".

Section 2.This Act shall not apply to members of the General Assembly who were elected to the General Assembly prior to its enactment.


SYNOPSIS

This Act would prohibit any member of the General Assembly from being employed by the State of Delaware while in office, unless the member was already a state employee at the time the member was elected to the General Assembly.For purposes of this bill, service in the General Assembly, in and of itself, would not be construed as employment by the State of Delaware.The act would only apply prospectively.
