HOUSE BILL NO. 398

AN ACT TO AMEND TITLE 17 OF THE DELAWARE CODE TO ENABLE LOCAL GOVERNMENTS TO CREATE TRANSPORTATION IMPROVEMENT DISTRICTS AND ESTABLISH FEES FOR TRAFFIC STUDIES FOR SUCH DISTRICTS.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend §101(a), Chapter 1, Title 17 of the Delaware Code by making deletions as shown by strikethrough and insertions as shown by underline as follows::

(3) "Development proposal" means a plan submitted to the Department of Transportation by an owner or developer of property for the purpose of obtaining either a Letter of No Objection to Recordation or an Entrance Plan Approval.

Section 2.Amend Chapter 5, Title 17 of the Delaware Codeby making deletions as shown by strikethrough and insertions as shown by underline as follows:

§ 514.Transportation Improvement Districts, traffic studies.

(a)                 Local governments organized under Titles 9 or 22 of this Code are empowered to create transportation improvement districts ("TIDs") within their boundaries, in coordination with the Department, in order to provide for the orderly construction and reconstruction of necessary improvements to address traffic impacts of development taking place in such districts.

(b)                 For every TID created by local government there shall be an agreement between the local government and the Department regarding what traffic studies shall be needed.

(c)                 The local government may enact an appropriate fee schedule to cover the reasonable cost of conducting such traffic studies.Such fee shall be paid by any person or entity seeking to develop property within a TID.

(d)                 All funds received pursuant to subsection (c) of this section shall be credited to a separate account for each TID and such funds may only be spent to pay for traffic studies in that TID.


SYNOPSIS

This bill enables local governments, in coordination with the Department of Transportation, to create transportation improvement districts (TIDs) and an appropriate fee schedule for such studies.
