AN ACT TO AMENDVOLUME 51, CHAPTER 237, LAWS OF DELAWARE, AS AMENDED ENTITLED "AN ACT TO REINCORPORATE THE TOWN OF BRIDGEVILLE" RELATING TO APPOINTMENT AND REMOVAL OF A TOWN MANAGER.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):
Section 1.Amend Section 46, Chapter 237, Volume 51, Laws of Delaware, relating to APPOINTMENT AND REMOVAL OF A TOWN MANAGER, by making deletions as shown by strikethrough and additions as show by underlining as follows:
Section 46.APPOINTMENT AND REMOVAL OF A TOWN MANAGER.
The Commissioners may by ordinance
provide for and establish a Town Manager.It may state his qualification and duties and shall fix his salary. The
Town Manager shall be responsible to the Commissioners and may be removed by
the Commissioners upon a vote of two-thirds of the members thereof a
majority of the members elected to the Town Commissioners.The duties of other officers may be
eliminated and combined with the duties of the Town Manager may be
eliminated and combined with the duties of the Town Manager if the
ordinance so provides.Neither the
President nor any member of the Town Commissioners may be appointed Town
Manager during his term of office or with one year thereafter, except in the
event of a national emergency.
