HOUSE BILL NO. 358

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO FISCAL PROJECTIONS.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend §1902, Title 29 of the Delaware Code by inserting "or reduce" between "escalate" and "costs" in the fifth sentence of §1902, and by inserting "or increase" between "reduce" and "revenue" in the fifth sentence of§1902.

Section 2.Amend Chapter 19 (Fiscal Projections) of Title 29 of the Delaware Code by adding thereto a new section to read:

"§ 1903A.Fiscal projection when revenue increased.

Any bill or joint resolution which would havethe effect of increasing State revenue must have a 1-year projection attached thereto, which projection shall describe, as accurately as can reasonably be ascertained, the increase in revenue to the State for the first full fiscal year after the effective date of the legislation and the rationale used in determining such fiscal impact.The Controller General's responsibility herein shall be the same as in § 1902 of this title.".

Section 3.Amend §1904, Title 29 of the Delaware Code by inserting "prepared pursuant to §1903 or §1903A of this chapter," between "fiscal projection" and "with each" in the first sentence of §1904.


SYNOPSIS

This bill adds incoming revenue, if any, as part of a full-cost analysis of fiscal projections, often referred to as fiscal notes or F/N.Consideration would be given to the economic implications caused by action of the General Assembly in creating jobs and the revenue that might be generated, as well as predictable revenue calculated by contract or direct action.
