HOUSE BILL NO. 121

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO DISCLOSURE OF INFORMATION BY THE DEPARTMENT OF NATURAL RESOURCES AND ENVIRONMENTAL CONTROL.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend Chapter 80, Title 29 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§8031 Disclosure of Information

(a) For purposes of this section "directive" means any form of communication that either directs or suggests that the Department or the State (when the directive to the State applies to the powers, duties, or functions of the Department)adopt, implement, terminate, or deny a particular rule, regulation, plan, strategy, application, policy or concept.

(b)Within 5 days of receipt of a directive from any person, employee or agency of the Federal Government, the Department shall cause to be posted a copy of the directive on the Department website maintained by the State, with a link to the posted copies of these directives being available on the opening page of the website.


SYNOPSIS

DNREC often implements policies and strategies based upon directives issued by the Federal Government, including those from the U.S. Environmental Protection Agency.This Bill will require that any directive received by DNREC be automatically disclosed on the DNREC website without the necessity for a Freedom of Information Request.
