Summary

Section 1 of this Bill would ensure that Delaware medical providers do not take advantage of the section of the statute that allows for the “greater of” clause by opening a facility across state lines to perform procedures on patients that could be performed in state to collect higher fees. At the same time, the Bill preserves the original intent of the statute, which allows an injured worker to receive specialized treatment outside the state. Section 2 of the Bill provides for medical provider’s (physician) report to serve as the triggering event for the completion of the employer’s report of modified-duty availability.
