This Bill is intended to facilitate the hosting of temporary large events in the State of Delaware, such as music festivals, car shows, auctions or conventions, by exempting such events from a provision in the Code that prohibits the holder of a license to sell alcohol in Delaware that hosts such an event on its property from sharing the profits of alcohol sales from the event with the promoter of the event. The removal of this prohibition is intended to attract large events from other jurisdictions where such revenue sharing is customary. The licensee would remain responsible for the purchase, resale and dispensing of all alcohol in accordance with existing laws and regulations and the temporary large event promoter would be required to obtain a temporary large event license and provide certain assurances to the Commissioner by an affidavit under oath, such as agreeing to comply with all applicable laws and regulations and agreeing to submit to the jurisdiction of the Commissioner and the courts of the State of Delaware.
