Summary
This bill provides that when a charge over which the Court of Common Pleas has jurisdiction is brought along with the violation of an ordinance, the violation and charge may be jointly transferred to the Court of Common Pleas, if such a transfer is elected by the Defendant. This bill allows the transfer to occur notwithstanding the Court of Common Pleas’ existing lack of jurisdiction over county ordinances. This allowance creates a cleaner and more efficient process for both the judicial system and the public by not requiring the splitting of cases.
Title
An Act To Amend Title 11 Of The Delaware Code Relating To The Jurisdiction Of The Court Of Common Pleas.
