AN ACT CONCERNING WORKERS' COMPENSATION AWARDS AND ATTORNEY FEES.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That the general statutes be amended to require that, whenever an employer or insurer has contested a workers' compensation claim that is ultimately resolved in favor of the claimant, twenty per cent of the sum reimbursed to the insurance company that paid medical benefits on behalf of the claimant shall be withheld and no attorney's fees shall be paid from such sum, pending resolution of the workers' compensation claim.

Statement of Purpose:

To require insurance companies that pay medical benefits to or on behalf of a workers' compensation claimant pending resolution of a claim to pay their fair share of the cost of recovering the sum.
