AN ACT CONCERNING TOXIC FLAME RETARDANTS IN CHILDREN'S PRODUCTS.
Be it enacted by the Senate and House of Representatives in General Assembly convened:
Section 1. (NEW) (Effective October 1, 2016) (a) As used in this section:
(1) "Children's product" means any product designed or intended primarily for use by children three years of age or younger, including, but not limited to, clothing, toys, nursing pillows, crib mattresses, changing pads, strollers and car seats.
(2) "TDCPP" and "TDCP" means tris (1,3-dichloro-2-propyl) phosphate.
(3) "TCEP" means tris (2-chloroethyl) phosphate.
(4) "TCPP" means tris (1-chloro-2-propyl) phosphate.
(b) On and after October 1, 2016, no person shall manufacture, sell, offer for sale or distribute in this state any children's product containing TDCPP, TDCP, TCEP or TCPP, except for such products governed by federal motor vehicle standards contained in 49 CFR Section 571.302.
(c) The provisions of subsection (b) of this section shall not apply to any individual who, for personal, family or household purposes, resells, offers for resale or distributes children's products.
(d) The Commissioner of Consumer Protection shall, within available appropriations, enforce the provisions of this section.
(e) The Commissioner of Consumer Protection shall, after notice and hearing pursuant to chapter 54 of the general statutes, levy a civil penalty on any person who violates the provisions of subsection (b) of this section of not more than one thousand dollars per day that such children's products are manufactured, sold, offered for sale or distributed for the first violation and not more than two thousand five hundred dollars per day for any subsequent violation. Such penalty shall be deposited into the consumer protection enforcement account established pursuant to section 21a-8a of the general statutes.
This act shall take effect as follows and shall amend the following sections: | ||
