AN ACT PERMITTING LOCAL POLICE TO CHARGE FOR MOTOR VEHICLE ACCIDENT OR INVESTIGATIVE REPORTS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. Section 7-282 of the general statutes is repealed and the following is substituted in lieu thereof (Effective October 1, 2011):

(a) The police department of any city, town or borough having or receiving any memoranda, sketches, charts, written statements, reports or photographs made in the investigation of any accident wherein any person has been injured or property damaged shall preserve and retain the same for a period of at least ten years from the date of such accident. Subsequent to the final disposition of any criminal action arising out of an accident, the records hereinbefore specified and the information contained therein shall be open to public inspection, except that such records shall be available to any person involved in the accident subsequent to the issuance of a warrant or summons in such action.

(b) The police department of any city, town or borough having or receiving an accident report or any record described in subsection (a) of this section shall charge the following fees for the item or service indicated:

(1) Each search of the record files made pursuant to a request for a copy of a motor vehicle accident or investigative report that results in no document being produced, eight dollars.

(2) Each copy of a motor vehicle accident or investigative report, sixteen dollars.

This act shall take effect as follows and shall amend the following sections:

To permit local police departments to charge for motor vehicle accident or investigative reports, parallel to the Commissioner of Public Safety's authority to charge for such reports.
