AN ACT CONCERNING REPLACEMENT OF SERVICE LINES BY A WATER COMPANY AND WATER TESTING.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective October 1, 2018) (a) As used in this section:

(1) "Curb stop" means the location at or adjacent to the street line or the customer's property line;

(2) "Lead service line" means a water service line that runs from the curb stop to the place of consumption on the customer's premises and that tested positive for containing lead;

(3) "Service connection" means the service pipe that runs from the water main to the curb stop; and

(4) "Water company" has the same meaning as provided in section 16-1 of the general statutes.

(b) A water company may submit a lead service line replacement plan to the Public Utilities Regulatory Authority identifying the number of lead service lines such water company is proposing to replace. Such plan shall identify the (1) number of lead service lines to be replaced, (2) proposed schedule of replacement of such lines, (3) total cost of replacement of such lines, (4) opportunity to perform any such replacements in conjunction with the replacement of service connections, (5) amount and duration of any proposed rate adjustment or surcharge to be imposed to cover all or a portion of the costs of replacement, and (6) portion of the total replacement costs to be borne by the customer.

(c) Notwithstanding any provision of the general statutes, the Public Utilities Regulatory Authority may (1) approve a plan submitted under subsection (b) of this action and authorize a water company to recover any costs to the water company for replacing its customers' lead service lines by (A) including such costs in its rate base and adjusting consumer rates accordingly, or (B) implementing a customer surcharge to recover such costs, or (2) reject such plan.

Sec. 2. (NEW) (Effective July 1, 2018) No municipal health department or district department of health shall require a business located within its jurisdiction to submit to and pay for water testing more frequently than the Department of Public Health requires a business to submit to and pay for such testing.

This act shall take effect as follows and shall amend the following sections:
