AN ACT TRANSFERRING THE CONSERVATION FUNCTIONS OF THE DEPARTMENT OF ENERGY AND ENVIRONMENTAL PROTECTION TO THE DEPARTMENT OF AGRICULTURE.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (Effective July 1, 2012) On and after July 1, 2012, the functions, powers and duties of the Commissioner of Energy and Environmental Protection and the Department of Energy and Environmental Protection that are described in title 23 or title 26 of the general statutes shall be transferred to the Commissioner of Agriculture and Natural Resources and the Department of Agriculture and Natural Resources, respectively. In accordance with the provisions of section 4-38d of the general statutes, any employee of the Department of Energy and Environmental Protection who performs any function or duty that is described in title 23 or title 26 of the general statutes shall be transferred to the Department of Agriculture and Natural Resources.

Sec. 2. (Effective July 1, 2012) (a) There is established a Department of Agriculture and Natural Resources. The department head shall be the Commissioner of Agriculture and Natural Resources, who shall be appointed by the Governor in accordance with the provisions of sections 4-5 to 4-8, inclusive, of the general statutes, as amended by this act, with the powers and duties therein prescribed.

(b) The Department of Agriculture and Natural Resources shall constitute a successor department to the Department of Agriculture in accordance with the provisions of sections 4-38d, 4-38e and 4-39 of the general statutes.

(g) If the term "Department of Agriculture" is used or referred to in any public or special act of 2012, or in any section of the general statutes which is amended in 2012, it shall be deemed to refer to the Department of Agriculture and Natural Resources.

(h) If the term "Commissioner of Agriculture" is used or referred to in any public or special act of 2012, or in any section of the general statutes which is amended in 2012, it shall be deemed to refer to the Commissioner of Agriculture and Natural Resources.

Sec. 3. Section 4-5 of the 2012 supplement to the general statutes is repealed and the following is substituted in lieu thereof (Effective July 1, 2012):

As used in sections 4-6, 4-7 and 4-8, the term "department head" means Secretary of the Office of Policy and Management, Commissioner of Administrative Services, Commissioner of Revenue Services, Banking Commissioner, Commissioner of Children and Families, Commissioner of Construction Services, Commissioner of Consumer Protection, Commissioner of Correction, Commissioner of Economic and Community Development, State Board of Education, Commissioner of Emergency Services and Public Protection, Commissioner of Energy and Environmental Protection, Commissioner of Agriculture and Natural Resources, Commissioner of Public Health, Insurance Commissioner, Labor Commissioner, Liquor Control Commission, Commissioner of Mental Health and Addiction Services, Commissioner of Social Services, Commissioner of Developmental Services, Commissioner of Motor Vehicles, Commissioner of Transportation, Commissioner of Veterans' Affairs, the director of the Bureau of Rehabilitative Services and the executive director of the Office of Military Affairs. As used in sections 4-6 and 4-7, "department head" also means the Commissioner of Education and the president of the Board of Regents for Higher Education.

Sec. 4. Section 4-38c of the 2012 supplement to the general statutes is repealed and the following is substituted in lieu thereof (Effective July 1, 2012):

There shall be within the executive branch of state government the following departments: Office of Policy and Management, Department of Administrative Services, Department of Revenue Services, Department of Banking, Department of Agriculture and Natural Resources, Department of Children and Families, Department of Consumer Protection, Department of Correction, Department of Economic and Community Development, State Board of Education, Department of Emergency Services and Public Protection, Department of Energy and Environmental Protection, Department of Public Health, Board of Regents for Higher Education, Insurance Department, Labor Department, Department of Mental Health and Addiction Services, Department of Developmental Services, Department of Social Services, Department of Transportation, Department of Motor Vehicles, Department of Veterans' Affairs and Department of Construction Services.

This act shall take effect as follows and shall amend the following sections:

Statement of Purpose:

To transfer the conservation functions, including forestry, parks and fish and game, from the Department of Environmental Protection to the Department of Agriculture and rename the Department of Agriculture as the Department of Agriculture and Natural Resources.
