AN ACT REQUIRING CARBON MONOXIDE DETECTION AND WARNING EQUIPMENT ON A MOTORBOAT WITH AN ENCLOSED ACCOMMODATION COMPARTMENT.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective October 1, 2018) (a) For the purposes of this section, (1) "enclosed accommodation compartment" means one contiguous space surrounded by boat structure which contains a: (A) Designated sleeping accommodation, (B) galley area with a sink, and (C) head compartment; and (2) "marine carbon monoxide detection and warning equipment" means equipment that meets the requirements of the American Boat and Yacht Council Standard A-24 for carbon monoxide detection systems.

(b) No person shall operate or give permission for the operation of any motorboat that has an enclosed accommodation compartment on the waters of this state unless such motorboat is equipped with a functioning marine carbon monoxide detection and warning equipment installed in accordance with the manufacturer's instructions.

This act shall take effect as follows and shall amend the following sections:

To prohibit the operation of a motorboat with an enclosed accommodation compartment that is not equipped with marine carbon monoxide detection and warning equipment.
