AN ACT CONCERNING THE THRESHOLD TO PROVE EXISTENCE OF A PUBLIC NUISANCE UPON REAL PROPERTY.
Be it enacted by the Senate and House of Representatives in General Assembly convened:
That subsection (i) of section 19-343a of the general statutes be amended to provide that the threshold of evidence to create a rebuttable presumption of a public nuisance upon real property be lowered from three arrests or issuance of three arrest warrants to two arrests or issuance of two arrest warrants during the three-year period prior to the commencement of the action, rather than during the three hundred sixty-five-day period prior to such commencement.
Statement of Purpose:
To lower the threshold for the state to prove the existence of a public nuisance upon real property.
